Terms of Service

By accessing or using OPKOS, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms and our Privacy Policy.

If you are using OPKOS on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

OPKOS is an AI-driven operational psychology and psychometric assessment platform. It provides cognitive and behavioral assessments, development protocols, rank-based progression systems, and related content to help users understand and develop their mental performance.

OPKOS is designed for personal development purposes only. It is not a licensed clinical tool, not a substitute for medical or psychological treatment, and should not be used to diagnose any mental health condition.

• You must provide accurate and complete information when registering.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately at support@opkos.ai if you suspect unauthorized access to your account.
• You may not share your account or transfer it to another person.
• We reserve the right to suspend or terminate accounts that violate these Terms.

Certain features of OPKOS require a paid subscription. By subscribing:

• You authorize OPKOS (via Stripe) to charge your payment method on a recurring basis at the then-current subscription rate.
• Subscriptions renew automatically unless cancelled before the renewal date.
• You may cancel at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period — no partial-period refunds are issued unless required by applicable law.
• We reserve the right to change subscription pricing with at least 14 days' advance notice. Your continued use after the effective date constitutes acceptance of the new price.
• Failed payments may result in suspension of access. You are responsible for keeping payment information current.

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable law.
• Attempt to reverse-engineer, copy, reproduce, or extract any assessment instruments, scoring algorithms, or proprietary methodologies.
• Share assessment results or content in ways that infringe OPKOS intellectual property rights.
• Impersonate other users or attempt to gain unauthorized access to other accounts.
• Use automated tools (bots, scrapers, crawlers) to access or collect data from the platform.
• Interfere with the security or integrity of the platform or its underlying systems.
• Harass, intimidate, or harm other users.
• Use OPKOS for commercial re-sale, sublicensing, or as a component of a competing service without written permission.

All content, assessments, methodologies, protocols, scoring systems, frameworks, rank systems, and platform technology are the exclusive proprietary assets of OPKOS.AI and its Founder. This includes but is not limited to The Blacksmith™ and The Forge™ brands and frameworks.

OPKOS grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for your own personal development purposes. This license does not include the right to copy, distribute, modify, or create derivative works from any platform content.

Your personal assessment results belong to you. You may download and retain your own results for personal use.

OPKOS is not a licensed healthcare provider. Nothing on the platform constitutes medical advice, psychological counseling, or therapy.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• OPKOS IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
• OPKOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
• OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO OPKOS IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not permit limitation of certain warranties or liabilities; in those cases, limitations apply to the fullest extent permitted by law.

You agree to indemnify and hold harmless OPKOS, its Founder, officers, employees, and agents from any claims, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason with reasonable notice. You may terminate your account at any time by contacting support@opkos.ai.

Upon termination, your right to use the platform ceases immediately. Sections regarding intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.

These Terms are governed by the laws of the United States and the state in which OPKOS is registered, without regard to conflict-of-law principles. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation.

If negotiation fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), on an individual basis. You waive any right to participate in class action lawsuits or class-wide arbitrations.

Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction for intellectual property infringement or misappropriation of confidential information.

We may update these Terms from time to time. If we make material changes, we will provide notice via email or prominent platform notice at least 14 days before the changes take effect. Your continued use of OPKOS after the effective date constitutes acceptance of the updated Terms.
